These Terms of Service ("Terms") govern your access to and use of HandleMyCase, available through https://handlemycase.org/, and related services operated by Arcodify Agency and LEX Nepal Law Firm ("HandleMyCase", "we", "us", or "our").

By creating an account or using HandleMyCase, you agree to these Terms. If you do not agree to these Terms, you must not use the service.

1. Eligibility

You must be at least 18 years old and legally capable of entering into an agreement to use HandleMyCase.

By using the service, you represent that the information you provide is accurate and that you are legally authorised to use the service.

2. User Accounts

Certain features require a registered account.

You are responsible for:

  • Providing accurate account information
  • Maintaining the confidentiality of your credentials
  • Maintaining control of your Google account if Google Sign-In is used
  • Preventing unauthorised access to your account
  • All activity occurring through your account
  • Immediately notifying us of suspected unauthorised access

Accounts may not be sold, transferred, shared, rented, or provided to another person without our permission.

3. Description of the Service

HandleMyCase provides software and online functionality for case management, document management, searching, communication, organisation of legal information, AI-assisted processing, and related services.

Features may be added, modified, replaced, restricted, suspended, or discontinued from time to time.

4. Legal Services and Lawyer-Client Relationship

Access to HandleMyCase does not by itself create a lawyer-client, advocate-client, fiduciary, advisory, or professional relationship with Arcodify Agency, LEX Nepal Law Firm, or any individual lawyer.

A professional lawyer-client relationship exists only where separately and expressly established through an appropriate engagement or agreement.

Where legal services are separately provided by LEX Nepal Law Firm or another legal professional, those services may be subject to additional engagement terms, professional duties, fees, confidentiality requirements, and applicable laws.

5. AI-Assisted Features

HandleMyCase may provide internally developed artificial intelligence, automation, document-processing, search, summarisation, classification, or similar functionality.

AI-generated or automatically generated content may contain errors, omissions, outdated information, incorrect interpretations, or inaccurate results.

You must independently verify material information before relying on it for legal, financial, procedural, commercial, or other significant decisions.

Unless expressly provided as part of a separate professional legal engagement, AI-generated information is not legal advice and should not be treated as a substitute for advice from a qualified legal professional.

6. User Content and Uploaded Documents

You may upload documents, images, messages, case information, contact information, and other materials ("User Content") where supported by the service.

You represent that you have all rights, permissions, authorisations, or other lawful bases necessary to provide the User Content to HandleMyCase.

You must not upload information unlawfully obtained from another person or information that you are prohibited from possessing, processing, or disclosing.

As between you and HandleMyCase, you retain any ownership rights that you already hold in your original User Content.

You grant HandleMyCase a limited, non-exclusive right to host, copy, store, process, analyse, transmit, display internally, modify technically, and otherwise use User Content only as reasonably necessary to operate, secure, maintain, improve, and provide the service or comply with applicable law.

This licence does not transfer ownership of your pre-existing documents or intellectual property to HandleMyCase.

7. Private Content

User Content submitted through HandleMyCase is intended to remain private and is not intended for public publication through the platform unless a feature expressly states otherwise.

Users may not use the service to intentionally expose another person's confidential, private, or protected information without lawful authority.

8. Paid Services

Some or all HandleMyCase features may require payment.

Applicable prices, billing periods, payment requirements, and available service levels will be displayed or communicated before purchase where applicable.

You agree to pay all applicable fees associated with the services you purchase.

Access to paid functionality may be limited or suspended if required payment is not received.

Unless expressly stated otherwise at the time of purchase or required by applicable law, fees already paid are non-refundable.

If recurring subscriptions are introduced or offered, the applicable billing cycle, renewal terms, cancellation procedure, and charges will be disclosed before the user enters the subscription.

9. Acceptable Use

You must not use HandleMyCase to:

  • Engage in illegal or unlawful activity
  • Violate the rights of another person
  • Harass, abuse, threaten, defame, or harm another person
  • Send spam or unsolicited communications
  • Upload malware, viruses, ransomware, malicious scripts, or harmful code
  • Attempt unauthorised access to accounts, systems, servers, or networks
  • Bypass authentication, access controls, rate limits, or security mechanisms
  • Probe, scan, or test vulnerabilities without written authorisation
  • Scrape, crawl, harvest, or systematically extract information without permission
  • Use bots or automated systems without authorisation
  • Reverse engineer, decompile, disassemble, or attempt to derive source code
  • Copy, reproduce, resell, sublicense, or commercially exploit the service without permission
  • Share, sell, rent, or transfer user accounts
  • Impersonate another individual or organisation
  • Upload material that infringes copyright, trademark, privacy, or other rights
  • Interfere with the operation or availability of the service
  • Consume excessive system, network, storage, AI, database, or computing resources
  • Attempt to circumvent payment requirements or service limitations
  • Use HandleMyCase to facilitate fraud, deception, cybercrime, or other harmful activity
  • Use information obtained through the service for an unlawful purpose

10. Suspension and Termination

We may restrict, suspend, or terminate access to HandleMyCase where we reasonably determine that:

  • These Terms have been violated
  • Required fees have not been paid
  • An account presents a security risk
  • The service is being abused
  • Illegal or prohibited activity is suspected
  • Continued access could cause harm to us, another user, or a third party
  • Suspension or termination is required by law or lawful authority

Serious violations may result in immediate termination without prior notice where reasonably necessary.

11. User Account Closure

Users may request account closure by contacting [email protected].

Account closure does not automatically eliminate outstanding payment obligations, legal obligations, records required to be retained, or liabilities arising before termination.

Information may continue to exist temporarily in backups, archives, security records, or legally required records after account closure.

12. Intellectual Property

HandleMyCase, including its software, interfaces, application functionality, databases, designs, branding, logos, documentation, proprietary processes, AI systems, and other platform materials, is owned by or licensed to Arcodify Agency, LEX Nepal Law Firm, or their applicable licensors.

Except where expressly permitted, these materials may not be copied, modified, reproduced, redistributed, reverse engineered, resold, sublicensed, or commercially exploited.

13. Third-Party Services and External Information

HandleMyCase may interact with or rely upon third-party services, authentication providers, hosting providers, databases, infrastructure providers, external websites, or court and judicial information systems.

We do not control all third-party services and do not guarantee their availability, completeness, security, accuracy, or continued operation.

14. Court and Legal Information

HandleMyCase may display, organise, retrieve, process, or reference information originating from courts, judicial systems, public records, or other external sources.

Such information may change, be delayed, contain errors, or differ from official records. Official court records and communications should be relied upon where authoritative confirmation is required.

15. Service Availability

We aim to maintain reliable access to HandleMyCase but do not guarantee uninterrupted or error-free operation.

The service may occasionally become unavailable because of maintenance, technical failures, infrastructure problems, security incidents, third-party outages, updates, governmental actions, or circumstances outside our reasonable control.

16. Disclaimer of Warranties

To the maximum extent permitted by applicable law, HandleMyCase is provided on an "as is" and "as available" basis.

We do not guarantee that the service, AI-generated output, search results, external records, case information, or other content will always be complete, accurate, current, uninterrupted, secure, or suitable for a particular purpose.

17. Limitation of Liability

To the maximum extent permitted by applicable law, HandleMyCase, Arcodify Agency, LEX Nepal Law Firm, and their respective officers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive losses arising from use of or inability to use the platform.

This includes, where permitted by law, losses relating to data, business interruption, missed deadlines, reliance on automated output, external service failures, unauthorised account activity, or decisions made using information obtained through the platform.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

18. Indemnification

To the extent permitted by law, you agree to be responsible for claims, losses, liabilities, damages, and reasonable costs arising from your unlawful use of HandleMyCase, your violation of these Terms, infringement of another person's rights, or User Content submitted without necessary authority.

19. Privacy

Use of HandleMyCase is also subject to our Privacy Policy, which describes how information is collected, used, stored, and disclosed.

20. Changes to the Service

We may modify, add, remove, suspend, or discontinue features of HandleMyCase where reasonably necessary for operational, security, business, technical, or legal reasons.

21. Changes to These Terms

We may update these Terms from time to time.

Updated Terms will be published through HandleMyCase with a revised effective date. Where appropriate, material changes may also be communicated through email, website notices, or in-app notifications.

Continued use of HandleMyCase after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.

22. Governing Law

These Terms are governed by the applicable laws of Nepal, without regard to conflict of law principles.

23. Disputes

Any dispute arising from these Terms or the use of HandleMyCase that cannot be resolved informally will be subject to the jurisdiction of the competent courts of Nepal, unless applicable law requires otherwise.

24. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

25. Entire Agreement

These Terms, together with the Privacy Policy and any additional terms expressly applicable to a particular service, constitute the agreement governing use of HandleMyCase.
